Welcome to contaCal. These Terms of Service ("Terms") govern your use of the contaCal mobile application ("App") and related services ("Service") provided by contaCal ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

contaCal is an AI-powered calorie and macronutrient tracking application available on iOS and Android. The Service includes:

You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

3. Account and Device Authentication

contaCal uses device-based authentication. You do not need to create a traditional account with an email address or password. Your device is identified by a unique device identifier, which is used to authenticate API requests via HMAC-SHA256 signing. You are responsible for maintaining the security of your device.

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier that includes manual food logging, barcode scanning, macro tracking, water tracking, and a limited number of AI-powered analyses (5 photo analyses and 5 voice inputs).

4.2 Pro Subscription

The Pro subscription unlocks unlimited AI photo analysis, unlimited voice input, unlimited text analysis, data export, and priority support. Pro is available at the following prices:

A 3-day free trial is included with new Pro subscriptions.

4.3 Billing and Renewal

Subscriptions are billed through your Apple App Store or Google Play Store account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

5. User Content

5.1 Your Content

You retain ownership of all content you submit through the App, including meal photos, voice recordings, text descriptions, and profile information ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service (e.g., analyzing meal photos to estimate nutritional content).

5.2 Content Processing

When you use AI-powered features, your User Content (photos, voice recordings, or text) is transmitted to our servers for processing. Photos and voice recordings are processed in real-time and are not permanently stored on our servers after analysis is complete. The resulting nutritional data is stored locally on your device.

5.3 Accuracy Disclaimer

AI-powered nutritional estimates are approximations and may not be perfectly accurate. The App is designed as a general wellness tool and should not be used as a substitute for professional dietary, medical, or nutritional advice. Always consult a healthcare professional for specific dietary needs.

The App, its design, features, and underlying technology are owned by contaCal and protected by applicable intellectual property laws. The contaCal name, logo, and branding are our trademarks. You may not use them without prior written permission.

The App integrates with the OpenFoodFacts database, which is available under the Open Database License (ODbL). Nutritional data from scanned barcodes is sourced from this community-maintained database.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTACAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICE.

contaCal is a wellness tracking tool. It is not a medical device and should not be used to diagnose, treat, or manage any health condition. You acknowledge that nutritional tracking is an approximation and that you are solely responsible for your dietary choices.

11. Data Deletion

You may delete all your data (meals, entries, and profile) at any time from within the App's Settings screen. This action is permanent and cannot be undone. For additional data deletion requests, contact us at the email address below.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. For material changes, we will provide notice through the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
